- Introduction
This Returns & Refunds Policy explains how returns, exchanges, and refunds are handled for transactions conducted on the Babaloop platform.
Babaloop operates as an online marketplace that connects private individuals who wish to sell or buy second-hand items. Babaloop does not own, sell, or ship the items listed on the Platform.
By using the Platform, you acknowledge and agree to the terms outlined in this Policy. - Nature of Babaloop’s Role
Babaloop provides the technical infrastructure that enables users to create listings, communicate, and complete transactions.
Babaloop is not a contractual party to transactions between buyers and sellers and does not act as an intermediary or agent for either party.
All sales and purchases are concluded directly between the users involved. - No Return or Refund Handling by Babaloop
Because Babaloop is not the seller, it does not manage, guarantee, or process returns, exchanges, or refunds. This means that:
Babaloop does not accept returned items;
Babaloop does not issue refunds or credits; and
Babaloop does not assume responsibility for the condition, quality, or authenticity of any listed item.
All return or refund discussions must be handled directly between the buyer and seller.\ - Buyer–Seller Responsibility
Buyers and sellers are solely responsible for ensuring that transactions are conducted fairly and that items are described accurately.
Before purchasing, buyers should carefully review:
The item description and photographs provided by the seller;
The seller’s rating or feedback history (if available);
The agreed delivery or collection terms.
Sellers are responsible for ensuring that all information provided about an item is truthful and not misleading.\ - Reporting Misuse or Fraud
While Babaloop is not responsible for disputes between users, it aims to maintain a safe and trustworthy marketplace.
Users are encouraged to report any suspected misuse, fraudulent activity, or policy violations via hello@babaloop.ch.
Upon receiving a report, Babaloop may — at its discretion — review the matter and take appropriate action, such as:
Suspending or terminating user accounts;
Removing problematic listings;
Cooperating with competent authorities when required by law.\ - Refunds for Technical or Platform-Related Issues
If a transaction fee or platform charge was incorrectly applied or duplicated due to a technical error on Babaloop’s side, users may contact Babaloop at hello@babaloop.ch within 14 days of the transaction. After verification, Babaloop may issue a fee refund limited to the platform charges involved, not the purchase amount of the item. - Final Provisions
This Policy is governed by Swiss law. The courts of Zurich, Switzerland, shall have exclusive jurisdiction over any dispute relating to this Policy or the use of the Platform.
Babaloop reserves the right to amend this Policy at any time. Any updates will be published on the Platform with the “Last updated” date revised accordingly.
